Cancellation, Refund & Rescheduling Policy
Don Dolce Limited Liability Company is committed to delivering exceptional
hospitality and entertainment. Each confirmed reservation
requires advance scheduling, financial commitments,
personnel arrangements, and the allocation of resources
specifically for the client's event.
The following terms establish the conditions governing
reservation deposits, cancellations, rescheduling,
service interruptions, refunds, and circumstances
affecting the performance of contracted services.
1. Reservation Deposits & Financial Commitments
A reservation deposit equal to 50% of the total
contracted service price is required to secure an
event date, unless a different amount is expressly
specified in the signed service agreement.
All reservation deposits are non-refundable upon
confirmation of the booking, except as expressly
provided in this policy or required by applicable law.
Upon confirmation, Don Dolce Limited Liability Company commits personnel,
compensates reserved performers, allocates operational
resources, and removes the contracted date from
general booking availability.
These commitments represent immediate financial
obligations and potential lost business opportunities.
The parties acknowledge that the financial consequences
of a canceled reservation may be difficult to calculate
precisely at the time of booking.
The reservation deposit is intended as reasonable
compensation for these anticipated commitments and
losses, rather than as a penalty imposed upon the client.
The enforceability of any retained deposit remains
subject to applicable law.
2. Client-Initiated Cancellations
If a client cancels a confirmed reservation for
reasons attributable to the client, the reservation
deposit is non-refundable, regardless of how far in
advance the cancellation occurs.
This policy applies to cancellations resulting from,
but not limited to, changes in personal circumstances,
financial difficulties, event postponements, changes
in event plans, reduced attendance, venue changes,
decisions to use another service provider, or the
client's inability or unwillingness to proceed
with the scheduled event.
A client-initiated cancellation does not automatically
entitle the client to a refund, service credit,
replacement event, transfer of the reservation deposit,
or alternative event date.
Payments received beyond the reservation deposit
will be applied to amounts properly owed for services
already performed, specifically authorized and
non-recoverable expenses, and other enforceable
obligations expressly established in the signed
service agreement.
Any remaining amount not properly owed will be
refunded. Don Dolce Limited Liability Company will not impose an additional
cancellation charge unless that charge is expressly
stated in the signed service agreement and is
enforceable under applicable law.
3. Rescheduling & Event Date Changes
Every confirmed reservation applies exclusively
to the event date specified in the signed
service agreement.
Any request to postpone, reschedule, or transfer
an event to another date is subject to the
written approval of Don Dolce Limited Liability Company.
Don Dolce Limited Liability Company makes no guarantee that the originally
reserved performer, additional personnel, equipment,
or requested services will be available on an
alternative date.
A client-requested date change does not automatically
preserve the original deposit or create a right to
a refund, credit, or replacement reservation.
If Don Dolce Limited Liability Company agrees to modify the existing
reservation, the parties will confirm in writing
how previously received payments will be applied
to the revised engagement, together with any
approved changes in pricing or expenses.
If the original reservation is canceled and the client
elects to establish an entirely new reservation,
a separate deposit may be required. Any charges
associated with the original cancellation remain
subject to this policy and applicable law.
Don Dolce Limited Liability Company is not obligated to accept a
rescheduling request or maintain pricing,
personnel availability, or other arrangements
for an unconfirmed replacement date.
4. Client, Guest & Venue Responsibilities
The client is responsible for ensuring that the
event location is suitable, accessible, legally
permitted, and properly prepared for the
contracted services.
This includes obtaining necessary venue approvals,
arranging reasonable preparation space, disclosing
applicable restrictions, and coordinating with
event organizers or other vendors as necessary.
Don Dolce Limited Liability Company is not responsible for delays,
interruptions, reduced service time, or inability
to perform resulting from circumstances attributable
to the client, guests, event organizer, venue
management, or third-party vendors acting on
the client's behalf.
Such circumstances do not independently create
a right to a refund of the reservation deposit,
except where required by applicable law.
If Don Dolce Limited Liability Company is present and reasonably prepared
to perform, but performance is prevented by the
client's failure to satisfy agreed event requirements,
the company may treat the engagement as a
client-caused cancellation or interruption.
5. Inability to Perform by Don Dolce Limited Liability Company
If Don Dolce Limited Liability Company is unable to provide the contracted
services due to circumstances reasonably within
the company's control, all payments received
for the affected services will be refunded in full.
This includes preventable operational failures,
inability to supply required personnel, or other
company-related circumstances that prevent
fulfillment of the contracted engagement.
When appropriate, Don Dolce Limited Liability Company may offer a
qualified replacement performer or team capable
of delivering substantially equivalent services.
Where the signed service agreement permits
performance by qualified substitute personnel,
the assignment of an appropriate substitute
does not, by itself, constitute nonperformance.
Where the signed service agreement expressly
guarantees the personal appearance of a
particular performer, the substitution of
another performer requires the client's approval.
If the contracted services cannot be delivered
through an authorized replacement arrangement,
all payments received for the affected services
will be refunded within 14 business days,
subject to any shorter deadline required by law.
Any additional compensation expressly guaranteed
in the signed service agreement remains payable
according to that agreement and is not eliminated
by the liability limitation below.
6. Extraordinary Events Beyond Reasonable Control
Neither party will be considered in breach solely
because performance is prevented by an extraordinary
event beyond that party's reasonable control,
provided the affected party did not cause the
event and makes commercially reasonable efforts
to minimize its effects.
Such events may include natural disasters,
severe weather creating objectively unsafe
conditions, government orders, legally mandated
venue closures, declared emergencies,
transportation shutdowns, significant road
closures, civil disturbances, terrorism,
or other extraordinary circumstances that
materially prevent safe or lawful performance.
An ordinary weather forecast, anticipated
inconvenience, lower guest attendance, or
voluntary change of plans does not, by itself,
establish an extraordinary event under
this section.
If a qualifying extraordinary event prevents
performance, Don Dolce Limited Liability Company will first offer
the opportunity to arrange an alternative date,
subject to mutual agreement and availability.
Neither party is obligated to accept an alternative
date. Don Dolce Limited Liability Company does not guarantee the
availability of any substitute event date.
If rescheduling is not mutually agreed upon,
payments received for services not performed
will be refunded, less documented, non-recoverable
third-party expenses that the client specifically
authorized in writing before those expenses
were incurred, to the extent permitted by law.
Don Dolce Limited Liability Company will make commercially reasonable
efforts to reduce avoidable losses, including
seeking available supplier refunds or travel
credits where reasonably possible.
Refunds under this section will be processed
within 14 business days after the refundable
amount can reasonably be determined, subject
to any shorter legally required deadline.
7. Travel, Lodging & Third-Party Expenses
Certain engagements require advance commitments
for transportation, lodging, specialty products,
custom materials, and other event-specific expenses.
Expenses expressly approved by the client in
writing may become non-recoverable once purchased,
reserved, manufactured, or otherwise committed.
Client-requested cancellations or modifications
do not automatically eliminate responsibility
for authorized, non-recoverable expenses,
provided those amounts are recoverable under
the signed service agreement and applicable law.
Don Dolce Limited Liability Company is not responsible for independent
failures of airlines, hotels, transportation
providers, or other third parties beyond the
company's reasonable control.
Don Dolce Limited Liability Company will nevertheless take reasonable
steps to arrange alternative performance
when practical.
No expense may be recovered twice through
both a retained deposit and a separate charge.
8. Delays, Service Interruptions & Early Termination
The contracted service period begins and ends
according to the times established in the
signed service agreement.
Delays caused by the client, venue, guests,
or third parties do not automatically extend
the contracted service period.
Don Dolce Limited Liability Company may suspend or discontinue
services if personnel encounter threatening
behavior, unlawful activity, unsafe conditions,
or serious interference with the performance
of contracted duties.
When reasonably practical, the company will
provide an opportunity to correct such
conditions before terminating service.
A client-caused interruption or termination
does not automatically entitle the client
to a refund.
Any refund or adjustment will be determined
according to the cause of the interruption,
services already provided, applicable
contractual obligations, and governing law.
9. Changes in Guest Count & Service Requirements
Once a reservation is confirmed, a reduction
in guest count, event duration, service scope,
or other client-requested arrangements does
not automatically reduce the agreed Contract Price.
Material changes to event location, schedule,
staffing requirements, specialty products,
or other contracted arrangements require
written approval from Don Dolce Limited Liability Company.
Approved changes may result in additional
charges or revised service terms, which must
be disclosed and accepted in writing before
becoming binding.
10. Limitation of Liability
To the fullest extent permitted by applicable
law, Don Dolce Limited Liability Company will not be liable for
indirect, incidental, special, or consequential
damages arising from cancellation, rescheduling,
delay, or interruption of contracted services.
These damages may include unrelated event
expenses, lost business opportunities,
lost profits, reduced attendance, or losses
arising from arrangements with other vendors.
Except for the exclusions below, Don Dolce Limited Liability Company's
total contractual liability for an affected
engagement will not exceed the total amount
paid to Don Dolce Limited Liability Company for the affected services.
This limitation does not reduce express refund
obligations under this policy, additional
compensation expressly promised in the signed
service agreement, or liability arising from
fraud, willful misconduct, gross negligence,
bodily injury, property damage, or obligations
that cannot lawfully be limited.
11. Written Cancellation & Notice Requirements
Requests for cancellation, rescheduling,
changes in service arrangements, or refund
consideration must be submitted in writing
to Reserve@DonDolce.com.
A written notice is considered received
when it reaches Don Dolce Limited Liability Company's designated
email system, provided the sender does
not receive an automated delivery
failure notification.
Receipt of a cancellation or rescheduling
request does not constitute acceptance
of any requested modification.
Modifications become effective only when
confirmed in writing by an authorized
representative of Don Dolce Limited Liability Company.
12. Governing Law & Dispute Resolution
This policy and the associated service
agreement will be governed by the laws
of the State of Delaware, without regard
to conflict-of-law rules, except where
another jurisdiction's mandatory laws apply.
Subject to applicable consumer protection
laws and any mandatory jurisdictional
requirements, disputes arising from the
service agreement will be brought before
a court of competent jurisdiction located
in New Castle County, Delaware.
Before initiating formal legal proceedings,
the parties are encouraged to communicate
in good faith and attempt to resolve
disagreements directly.
Clients may submit written concerns to
Reserve@DonDolce.com. Don Dolce Limited Liability Company will
make reasonable efforts to respond within
14 calendar days.
Nothing in this policy waives or restricts
rights available under applicable consumer
protection laws or payment card dispute
procedures.
13. Electronic Acceptance & Agreement
This policy becomes part of the binding
service agreement only when expressly
incorporated into that agreement and
accepted by the client.
Acceptance may be established through
a physical signature or a legally valid
electronic signature or acknowledgment
process demonstrating the client's
agreement to the applicable terms.
Don Dolce Limited Liability Company may retain records of
signed agreements, accepted policy
versions, payment confirmations,
electronic acknowledgments, and
related correspondence.
The client consents to conducting the
contracting process electronically,
subject to applicable electronic
transaction and consumer disclosure laws.
14. Entire Agreement & Modifications
This policy, together with the signed
service agreement and any expressly
incorporated written addenda, establishes
the parties' agreed cancellation, refund,
and rescheduling obligations.
If a provision of the signed service
agreement conflicts with this policy,
the more specific provision expressly
accepted by both parties will govern,
provided it is legally enforceable.
No verbal statement, informal discussion,
or unauthorized communication modifies
these terms.
Exceptions or modifications require written
confirmation from an authorized representative
of Don Dolce Limited Liability Company.
15. Severability
If any provision of this policy is
determined to be invalid or unenforceable
by a court of competent jurisdiction,
the remaining provisions will continue
in effect to the extent permitted by law.
Any unenforceable provision will be
severed or limited only to the extent
legally permissible without altering
the essential purpose of the agreement.
